YOUR RIGHT TO CANCEL
SHOULD THE CUSTOMER WISH TO RETURN THE GOODS FOR ANY REASON OTHER
THAN BEING FAULTY, THE CUSTOMER HAS SEVEN (7) WORKING DAYS AFTER THE DAY OF DELIVERY TO RETURN THE ITEMS PURCHASED. ALL GOODS
MUST BE IN NEW, UNUSED, MINT CONDITION. THE CUSTOMER MUST INFORM HYPNOKE INTERNATIONAL, IN WRITING, WITHIN THE SEVEN DAY PERIOD
OF THEIR INTENTION TO RETURN THE GOODS.
POSTAGE OF RETURNED GOODS (BY INSURED (TO THE VALUE OF THE GOODS), NEXT
DAY DELIVERY ONLY-NO OTHER METHOD OF POSTAGE IS ACCEPTABLE) WILL BE PAID BY THE CUSTOMER AND IS NOT REFUNDABLE. THE CUSTOMER
SHOULD TAKE REASONABLE CARE TO REPACKAGE THE GOODS TO PREVENT ANY DAMAGE DURING RETURN POSTAGE.
MONEY WILL BE REFUNDED (LESS THE COST OF RETURN POSTAGE PAID BY THE CUSTOMER) WHEN THE GOODS ARE RECEIVED BY HYPNOKE INTERNATIONAL
IN THE CONDITION THEY WERE SENT OUT IN (UNUSED, MINT CONDITION AND IN FULL WORKING ORDER).
SHOULD THE GOODS BE
USED (NOT FAULTY), AND RETURNED WITHIN SEVEN (7) WORKING DAYS AFTER THE DAY OF DELIVERY, IN FULL WORKING ORDER, WITHOUT ANY
SIGNS OF DAMAGE, A SERVICE CHARGE OF £30.00 WILL BE LEVIED AGAINST ANY REFUND GIVEN AT HYPNOKE INTERNATIONAL’S
DISCRETION. THE CUSTOMER MUST INFORM HYPNOKE INTERNATIONAL, IN WRITING, WITHIN THE SEVEN-DAY PERIOD OF THEIR INTENTION TO
RETURN THE GOODS.
ANY GOODS RETURNED OUTSIDE OF SEVEN (7) WORKING DAYS, WHETHER USED OR UNUSED, (BUT NOT FAULTY),
SHALL HAVE ANY REFUND MADE AT THE DISCRETION OF HYPNOKE INTERNATIONAL. POSTAGE OF RETURNED GOODS (BY INSURED (TO THE VALUE
OF THE GOODS), NEXT DAY DELIVERY ONLY-NO OTHER METHOD OF POSTAGE IS ACCEPTABLE) WILL BE PAID BY THE CUSTOMER AND IS NOT REFUNDABLE.

THE GOODS BE FAULTY OR DAMAGED IN TRANSIT DURING DELIVERY TO THE CUSTOMER, THE UNIT CONCERNED WILL BE REPAIRED OR REPLACED
AT HYPNOKE’S DISCRETION AND ANY POSTAL COSTS INCURRED TO REPLACE THE FAULTY GOODS PAID FOR BY HYPNOKE INTERNATIONAL.
GOODS PURCHASED BY THE CUSTOMER - IN PERSON:
AND SALE OF GOODS ACT 1994: SHOULD THE CUSTOMER WISH TO RETURN THE GOODS FOR ANY REASON OTHER THAN BEING FAULTY, HAVING PURCHASED
THE GOODS IN PERSON FROM HYPNOKE INTERNATIONAL’S STAND AT ANY CONFERENCE/TRADE SHOW/EXHIBITION OR SEMINAR, ANY REFUND
MADE WILL BE AT THE DISCRETION OF HYPNOKE INTERNATIONAL, REGARDLESS OF WHETHER THE GOODS ARE USED OR UNUSED, (BUT NOT FAULTY).

IN ADDITION TO THOSE RELATING TO THE SUPPLY OF FAULTY GOODS.
HYPNOKE INTERNATIONAL WARRANTS THIS PRODUCT TO BE
FREE OF DEFECTS IN MATERIAL AND WORKMANSHIP FOR A PERIOD OF ONE (1) YEAR FOR PARTS AND FOR A PERIOD OF ONE (1) YEAR FOR LABOUR
FROM THE DATE OF THE ORIGINAL PURCHASE. THIS WARRANTY CANNOT BE TRANSFERRED OR ASSIGNED, AND IS SUBJECT TO THE PRODUCT BEING
CORRECTLY INSTALLED AND OPERATED IN ACCORDANCE WITH THE INSTRUCTIONS CONTAINED WITHIN THIS MANUAL.
DURING THE WARRANTY
PERIOD HYPNOKE INTERNATIONAL SHALL, AT ITS SOLE AND ABSOLUTE DISCRETION, EITHER REPAIR OR REPLACE FREE OF CHARGE ANY PRODUCT
THAT PROVES TO BE DEFECTIVE ON INSPECTION BY HYPNOKE INTERNATIONAL.
ALL WARRANTY ENQUIRIES MUST BE ACCOMPANIED
BY A DESCRIPTION OF THE PROBLEM. ALL RETURNS MUST BE SENT VIA A SECURE FORM OF POSTAGE, INSURED AND PROPERLY PACKAGED. HYPNOKE
INTERNATIONAL RESERVES THE RIGHT TO CHANGE OR IMPROVE DESIGN OF THE PRODUCT AT ANY TIME WITHOUT PRIOR NOTICE.
WARRANTY DOES NOT COVER CLAIMS FOR DAMAGE DUE TO ABUSE, NEGLECT, ALTERATION OR ATTEMPTED REPAIR BY UNAUTHORIZED PERSONNEL,
AND IS LIMITED TO FAILURES ARISING DURING NORMAL USE THAT ARE DUE TO DEFECTS IN MATERIAL OR WORKMANSHIP IN THE PRODUCT.
IN NO EVENT WILL HYPNOKE INTERNATIONAL BE LIABLE FOR INCIDENTAL, CONSEQUENTIAL, INDIRECT OR OTHER DAMAGES RESULTING
FROM THE BREACH OF ANY EXPRESS OR IMPLIED WARRANTY, INCLUDING AMONG OTHER THINGS, DAMAGE TO PROPERTY, DAMAGED BASED ON INCONVIENCE
OR ON LOSS OF USE OF THE PRODUCT, AND, TO THE EXTENT PERMITTED BY LAW, DAMAGES FOR PERSONAL INJURY.
IN ORDER TO
CONSTANTLY IMPROVE ITS PRODUCTS, HYPNOKE INTERNATIONAL RESERVES THE RIGHT TO ALTER OR CHANGE ITS PRODUCTS AT ANY TIME.

All commercially recorded music is controlled by Copyright Law and the use of this music without permission
infringes copyright and is a criminal offence.
Hypnoke International and the composer of Colours Vol 1 and Vol
2 (Paul Honey) owns the copyright to these compositions (“Works”) and sound recordings. Therefore we are in a
position to grant you a licence to use the music subject to the terms (“Terms”) and conditions set out below.
These Terms apply to all and any use of the Works in this agreement/website and if you do not accept them you
should not use this agreement/website, the Works or any part of them.
Subject to these Terms and except with Hypnoke
International’s prior written permission, Hypnoke International grants you a non-exclusive and non-transferable right
and licence to use Works for the purposes set out in these Terms only;
* download and stream from the website audio demos of the Works for preview and evaluation only; and
* upon payment of the Licence Fee (as defined below) use the Work or Works named in the licence for your
personal commercial and non-commercial use for the purposes of generating therapy related CDs, utilising the use of the therapist’s
* in using Works as permitted by these Terms modify or adapt the Works only by editing or
cutting provided that you do not do so to create a new composition.
You may not:
* use, copy, modify or adapt the Works other than as expressly permitted by these Terms; or
add lyrics to the Works; or
* use, modify or adapt any part of Works in any manner, including without
limitation by way of copying, sampling or looping for the purpose of creating any new composition or works; or
use the music for mass market productions, promotions and distribution such as feature films, worldwide television syndication
or production runs of commercial projects such as; but not limited to corporate, training, fitness, sports, wedding
DVDs and videos.
* stream the Works or use the Works
on the Internet except in Quicktime, Windows Media Player, Flash or Real Audio file format so that illegal downloading and
use of the Works is totally impossible; or
* sub-license, rent, assign, resell or otherwise deal in
the rights or Works licensed to you.
* commercially exploit or authorise any third party to commercially
exploit, including by way of commercial release of any Synchronisation containing the Works or any part of them.
Represent yourself as being connected in any way with Hypnoke International or Hypnoke.com.
agree and acknowledge that:
* Copyright (and all other like rights) in the Works is
owned by or licensed to Hypnoke International and Paul Honey, unless otherwise specified.
* In any
exploitation, by you of any Work you shall afford and shall procure that such third party affords Hypnoke International with
such credit as shall be reasonable.
* You shall not modify or adapt the Works or part thereof except
as expressly permitted in these Terms or by and in accordance with s. 296A(1) Copyright Designs and Patents Act 1988 or s.
50B(2) Copyright Designs and Patents Act 1988;
* Copyright (and all other like rights) in such modifications
and adaptations are and shall be the exclusive property of and vest in Hypnoke International on creation and you shall do
such acts as may be required for vesting absolutely full right, title, property and interest therein PROVIDED always that
you shall be entitled to use such Work, improvement and modification in accordance with these Terms.
In order to and in consideration of the right to use the Works for use as set out above
you agree to:
* pay to Hypnoke International the fee for the permitted use of a particular Work as
set out on in this agreement and in the Licence Fee;
* comply at all times with these Terms;
grant Hypnoke International or its representatives the rights, on giving you reasonable notice, to audit your works, commercial
dealings and accounts to ensure compliance with these Terms.
* The licence granted hereunder and the
Licence Fee does not include or cover performance rights. On public performance or commercial broadcast of the Works you shall
use your best endeavours to inform the relevant collection society in relation thereto and indemnify Hypnoke International
in relation thereto. None of the tracks in the royalty free music library are registered with any collecting organisation.
* To use the Works beyond the Terms you must send an email to email@example.com, or by post to Hypnoke
International, 78 Albany Road, West Green, Crawley, West Sussex RH11 7BZ, United Kingdom stating your requirements and intentions
and seeking consent, such consent to be withheld at the sole discretion of Hypnoke International.
* By submitting to purchase Colours Vol 1, a licence to use the Work or Works
named for the price stated, will be issued.
* All prices are quoted in GB Pounds and do not include
local import or sales taxes.
* Purchases of Colours Vol 1 and Vol 2 are subject to these terms and
conditions, will be confirmed by e-mail and are deemed accepted when we send out an e-mail acceptance OR the Works.
Works shall be dispatched in the audio CD format.
* Requests may be processed by phone or by fax,
using a stated credit or debit card or cheque sent to the address below. Hypnoke International does not accept cash. Transactions
using cheque will not be processed until such cheque has cleared.
* Hypnoke International may cancel
any sale and not supply Works if it is reasonable to do so and may change or discontinue the availability of items at any
time at its sole discretion.
* If the Works received are faulty please return to Hypnoke International
for a full refund or replacement, whenever possible and reasonable.
* Please note that in order to
make commercial exploitation of any Work you must be over the age of 18 years or else have your parents consent to do so on
these Terms. You therefore warrant that you are over 18 years of age or else have your parents consent and that your parents
have read and agree to these Terms.
* The licence granted hereunder arises only on receipt of payment
of the Fees in full and shall automatically terminate in the event that you breach these Terms.
Use of Hypnoke International and these terms are subject to the laws of England and the exclusive jurisdiction of English
